Pennsylvania Man Accused of Shooting Wife With Her Own Revolver After Party Argument in Rockledge, Authorities Say

ROCKLEDGE, PENNSYLVANIA — A 59-year-old man is accused of fatally shooting his wife with her own firearm following an argument that began at a party and ended in gunfire on a Montgomery County roadway.

Jose Luna has been charged with first-degree murder, third-degree murder, and prohibited possession of a firearm in the death of his wife, 48-year-old Alisett Schubert, according to the Montgomery County District Attorney’s Office.

Argument Escalates After Party

Authorities say Luna and Schubert attended a party Saturday night where an argument allegedly began after Luna claimed she had “disrespected him in front of others,” according to an affidavit of probable cause.

The couple left the gathering in a silver Nissan Murano, with Schubert driving. Prosecutors allege the dispute continued inside the vehicle as they traveled through Rockledge.

In the area of Fillmore Street and Huntingdon Pike, Schubert reportedly told Luna to get out and walk home. Court documents state the two began struggling over a .38 caliber revolver that was in Schubert’s purse and registered in her name.

Multiple Shots Fired

Investigators allege Luna gained control of the weapon and shot Schubert. According to the affidavit, she screamed as she attempted to flee the SUV. Authorities say Luna then fired four additional shots.

A SEPTA bus driver traveling in the area told investigators he heard several “pops” and observed a vehicle stopped in the roadway. He reported seeing a man exit the front passenger seat, open the driver’s side door, and a woman fall out of the vehicle.

The bus driver activated his emergency system around 10:05 p.m. to report the shooting and provided a description of the suspect.

Victim Pronounced Dead at Hospital

Police arrived to find Schubert lying on the ground outside the vehicle with multiple gunshot wounds. She was transported to a nearby hospital, where she was later pronounced dead.

Philadelphia police officers located Luna approximately one mile from the scene. According to prosecutors, as officers approached him, Luna placed a gun to his head and pulled the trigger, but the weapon was out of ammunition. He was taken into custody without further incident.

Authorities also allege that after the shooting, Luna called Schubert’s mother to tell her that her daughter was dead and that he intended to kill himself.

History of Alleged Abuse

According to court documents, Schubert had previously confided in a friend that Luna was physically and mentally abusive. The affidavit states that the friend once witnessed Luna punch his wife in the face.

Luna is scheduled to appear in court for a preliminary hearing on March 5. If convicted of first-degree murder, he could face life in prison.

As with all criminal cases, the charges are allegations, and Luna is presumed innocent unless and until proven guilty in court.
